Capitol Records to be sued for unpaid download sales

A courtroom battle involving the sister of late Knack drummer Bruce Gray and Capitol records is about to get underway after she filed a lawsuit against the label in LA.

Felice Catena claims the company is 'screwing her out of hard-earned digital download sales' paying her a fraction of what she's owned through downloads proceeds for tracks such as 'My Sharona' & 'Good Girls Don't.'

According to the lawsuit Capitol owes Catena as much as 50% of all net receipts earned via iTunes, eMusic, Amazon & others.

It would appear that Capitol are exploiting the fact that when the recording contract was first made provisions for digital downloads were non-existent. So when the digital download revolution hit it was unclear as to whether or not to pay the artists their sale fee of around 12% - 18% or their licensing fee of 50%.

Felice is claiming sales through digital distributors are actually licenses & plans to fight Capitol over the fact.
